Scope
These terms govern your use of the website at xdr.fluencesecurity.com and its subpages, including the public documentation ("the site"). The site is operated by Fluence Security - Paweł Mierzwa, NIP 9571182795 ("FluenceSecurity", "we").
By using the site you accept these terms. If you do not accept them, do not use the site. Use of the XenXDR platform, the endpoint agent, a hosted tenant or the managed service is governed by the software licence terms and by the agreement you sign with us, which take precedence over this document.
Intellectual property
The site, its design, text, illustrations, code samples and the XenXDR name and marks are owned by FluenceSecurity or its licensors and are protected by copyright, trademark and other laws. You may view, print and quote reasonable extracts of the documentation for the purpose of evaluating or operating XenXDR, provided you keep attribution and do not present the material as your own. Any other reproduction, distribution or modification requires our written consent.
Third-party names and marks mentioned on the site, such as Sigma, Splunk, Okta, Microsoft and Fortinet, belong to their respective owners and are used only to identify compatibility.
Acceptable use
You agree not to:
- probe, scan or test the security of the site other than under our vulnerability disclosure policy;
- attempt to gain unauthorised access to any part of the site or the systems behind it;
- send unsolicited or automated submissions through the contact form;
- scrape the site in a way that degrades it for others;
- use the site in breach of any applicable law.
Documentation is provided as is
The documentation describes the platform as of the version stated on each page. We work to keep it accurate, but it is provided without warranty of any kind. Product behaviour, defaults and the availability of individual integrations may change between versions. Where the documentation and your contract differ, the contract prevails.
Links to other sites
The site links to third-party sites, including fluencesecurity.com and the sites of open-source projects XenXDR builds on. We are not responsible for their content or their privacy practices.
Liability
To the extent permitted by law, FluenceSecurity is not liable for indirect or consequential loss arising from use of the site, including loss of profit or data. Nothing in these terms limits liability for wilful misconduct, gross negligence, or any liability that cannot be excluded under Polish law. If you are a consumer within the meaning of the Polish Civil Code, the mandatory consumer protections of your country of residence apply and prevail over any conflicting provision here.
Governing law and disputes
These terms are governed by the law of the Republic of Poland. Disputes are resolved by the Polish common court competent for our registered office, unless mandatory law provides otherwise. Consumers may also use the EU online dispute resolution platform at ec.europa.eu/consumers/odr.
Changes
We may change these terms when the site or the law changes. The version and date at the top identify the current text. Continued use of the site after a change means you accept the updated terms.
